Acceptance of terms

By accessing or using Brandomica Lab (website, API endpoints, or MCP endpoints), you agree to these Terms of Use.

Service scope

Brandomica Lab is a brand safety and availability research tool. Some checks are automated and some intentionally return manual-link fallbacks. Results may be incomplete and should be independently verified.

Brandomica Lab is an early MVP currently offered free of charge and without user accounts. The service is provided on a best-effort basis and we may change, limit, or discontinue features at any time without notice.

Not legal advice

Brandomica Lab is a brand safety and availability research tool, not a legal service. Results do not constitute legal advice. Trademark searches link to official registries (USPTO, EUIPO) for your own review — always consult a trademark attorney before making filing decisions.

Third-party services

Brandomica Lab depends on third-party services and data sources. We are not responsible for third-party content, uptime, policies, or pricing changes. Domain availability and pricing can change at any time.

Some data sources may operate in sandbox or limited-access mode while production credentials are pending. Results from these sources may have reduced coverage or freshness compared to production endpoints. We will update sources to production access as it becomes available.

Acceptable use

Brandomica Lab runs on shared infrastructure. Automated or bulk usage that degrades service for others may be throttled. App-level rate limits apply (MCP: 30 requests/minute burst, 50 requests/hour sustained; REST endpoints vary). The API and MCP endpoints are also subject to upstream rate limits from third-party providers.

You may not misuse the service, attempt to bypass protections, or use Brandomica Lab in violation of applicable law.

No warranty

Brandomica Lab is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, Brandomica Lab and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the service.

Our total liability for any claim relating to Brandomica Lab is limited to USD $100.

Indemnification

You agree to defend, indemnify, and hold harmless Brandomica Lab and its operator from claims, liabilities, damages, and expenses arising from your misuse of the service or violation of these terms.

Commercial and affiliate disclosure

Brandomica Lab may include outbound registration links and may include affiliate tracking now or in the future. This does not increase the price you pay to the registrar.

Service availability and allowed usage may also be affected by infrastructure provider terms.

Suspension and termination

We may suspend or terminate access to Brandomica Lab at any time, including for abuse, risk, legal compliance, or maintenance reasons.

Changes to these terms

We may update these terms from time to time. Continued use after an update constitutes acceptance of the revised terms.

Governing law and venue

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Exclusive venue for disputes is state or federal court in Delaware.
